These terms are an agreement between your business ("you") and Busy Hands Digital, registered in Ontario and based in Newmarket ("we", "us"). They apply when you use any of our services. Our services are for businesses only, and you must be at least 18 and able to agree on behalf of your business. If you've signed a written quote or service agreement with us, it works together with these terms; where the two differ, the signed document wins.
1. What we provide
Depending on what you choose: missed-call text-back with AI replies, job qualification and calendar booking; owner alerts and weekly reports; reminders, estimate follow-ups and review requests; and websites with optional hosting and care. Your quote lists exactly what's included.
2. Free pilot
New text-back clients can start with a free pilot, usually 30 days. There's no charge during the pilot and nothing is billed automatically when it ends. Before it ends we'll review the results with you. If you decide to continue, fees start as quoted. If you decide not to, you turn off call forwarding and we close the service.
3. Fees and billing
- Fees are as set out in your written quote: a one-time setup fee where applicable, and monthly fees billed in advance. HST is added.
- We'll give you at least 30 days' notice by email before any price change.
- Your phone carrier may charge for call forwarding, depending on your plan. Those charges are yours. We'll help you check your plan during setup.
- If an invoice is unpaid 15 days after it's due, we may pause the service after giving you notice.
4. Cancelling and refunds
- After the pilot, you can cancel anytime by giving us 30 days' notice by email. The service keeps running until the notice period ends.
- Fees paid after the pilot are non-refundable, including setup fees and partial months, except where the law requires otherwise.
- There's no long-term contract unless your signed quote says otherwise.
5. Your responsibilities
- Give us accurate information about your business, services, service area, hours and booking rules, and tell us when they change.
- Set up and keep conditional call forwarding on your phone (we'll walk you through it), and follow up on the leads and bookings we send you.
- Use the service lawfully, including Canada's Anti-Spam Legislation (CASL) and privacy law. The text-back service only replies to people who called your business. It may not be used for marketing blasts or texting people who didn't contact you, unless you have their separate express consent.
- You're responsible for the work you quote and perform, and for how you use the customer information we pass to you.
6. AI and automation: what to expect
- Text replies are written by AI following the rules we set up with you. Every text includes your business name and "Reply STOP to opt out."
- The AI never quotes prices, never promises arrival times and never gives safety advice. Callers who mention an emergency, such as a gas smell, sparking or flooding, are told to call 911 or to call you directly, and you're alerted right away.
- AI can misunderstand messages or make mistakes. You can read every conversation and take over at any time. Please review bookings before you rely on them.
- This is not an emergency service. We can't guarantee that every emergency will be recognized, and the text-back number cannot contact emergency services.
7. Phone numbers
Your existing business number stays yours and doesn't change. The text-back number we use behind the scenes is provided through our telecom provider and is assigned to your service only while it's active. When the service ends, we release that number, and you turn off call forwarding on your phone.
8. Websites
- Your domain (for example yourbusiness.ca) is registered in your business's name, and you pay its renewal. If you leave, it goes with you.
- Your content (text, photos and logos you give us) stays yours. You confirm you have the right to use it, and you let us use it to build and run your site.
- The finished site: once it's paid for, you may use it for as long as you like. If you end a care plan, we'll give you the site files and help you move them to new hosting. The reusable templates and tools we build our sites with stay ours.
- We may show your site in our portfolio unless you tell us not to.
9. Your customers' data
Information about your callers and customers belongs to your business. We use it only to provide your service, keep it separate from other clients' data, and handle it as described in our Privacy Policy. When the service ends, we'll send you an export on request within 30 days, then delete our copies on the schedule in the Privacy Policy.
10. Suspension
We may pause or end the service for unpaid invoices, misuse, spam, unlawful use, or if a telecom provider or regulator requires it. Where reasonable, we'll tell you first and give you a chance to fix the problem.
11. No guarantees
We work hard to make the service reliable, but it depends on phone carriers and other providers, and messages can be delayed or not delivered. The service is provided "as is." We don't guarantee a particular number of leads, bookings, reviews or search rankings.
12. Limit of liability
We're not liable for indirect or consequential losses, such as lost profits or lost jobs from missed, delayed or misrouted calls or messages. Our total liability for any claim is limited to the fees you paid us in the 3 months before the claim. Nothing in these terms limits liability that can't be limited by law.
13. Responsibility for your use
You agree to cover claims made against us that arise from your content, your instructions to us, or your breach of these terms or the law, to the extent they're caused by you.
14. Changes to these terms
We may update these terms. We'll email you at least 30 days before a significant change takes effect. Continuing to use the service after that means you accept the change.
15. Governing law
These terms are governed by the laws of Ontario and the federal laws of Canada that apply there.
